DMCA notice & takedown
Fallspots respects copyright. If you believe a page or image on this site infringes your work, send us a takedown notice and we'll act on it within 5 business days.
What to include in a notice
Per 17 U.S.C. § 512(c)(3), a valid DMCA notice must contain:
- Your physical or electronic signature.
- Identification of the copyrighted work claimed to be infringed (the URL of the original, or a description detailed enough to find it).
- Identification of the material on Fallspots that is allegedly infringing — a full URL to the page on our site, and the specific element (which photo, which paragraph, etc.).
- Your contact info: full name, mailing address, phone number, email.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate, and that you are the copyright owner or authorized to act on the owner's behalf.
Where to send it
Email the notice to: hello@fallspots.com with subject line DMCA Takedown.
What happens after
- We acknowledge receipt within 2 business days.
- If the notice is valid we remove or disable the contested material within 5 business days.
- We notify the original poster/contributor (if any) of the takedown.
- The contributor may file a counter-notice (see below). If they do, we forward it to you, and may restore the content after 10 business days unless you file suit.
Counter-notice
If you believe your content was wrongly removed, send a counter-notice with:
- Your signature.
- Identification of the material removed and the URL where it previously appeared.
- A statement under penalty of perjury that you have a good-faith belief the removal was a mistake or misidentification.
- Your full name, address, phone number, and a statement consenting to the jurisdiction of the federal court in the US district where you reside (or where Fallspots is located, if outside the US), and that you will accept service of process.
Repeat infringers
We maintain a policy of removing privileges from repeat infringers. Since Fallspots doesn't have user accounts this typically means blocking submission emails from the same address.
False notices
Under 17 U.S.C. § 512(f), knowingly submitting a false DMCA notice can make you liable for damages, including costs and attorney's fees. Please only file if you have a real claim.
Source attribution context
Note that we source data from OpenStreetMap (ODbL), USGS GNIS (public domain), Wikidata (CC0), Wikipedia (CC BY-SA), and photos from Wikimedia Commons with their respective licenses. If we're using your work via one of these platforms under its license terms, we may not be infringing — but we'll review every notice in good faith and remove the content if you prefer.
