Terms of service
Plain version: Fallspots is free to use. The data comes from public sources and we try to be accurate, but you're responsible for your own safety when visiting waterfalls. We can't be held liable for accidents.
1. Who we are
Fallspots is operated by Marina Vance and Theo Vance, two individuals based in the United States. Contact: hello@fallspots.com.
2. Acceptance
By using this website you agree to these terms. If you don't agree, please don't use the site. There's no signup so we can't enforce this contractually — it's a good-faith expectation.
3. Use of the site
You may:
- Browse, search, and read every page.
- Save links and share them however you like.
- Reference our pages in articles, social posts, and AI tools with attribution.
- Scrape the data we publish — we run an LLM-friendly /llms.txt for that purpose. Please don't hammer the server.
You may not:
- Republish our content verbatim at scale without attribution.
- Use the site for any unlawful purpose.
- Attempt to break security, denial-of-service, or otherwise impair the site for others.
- Misrepresent our content (e.g., presenting fake safety claims as ours).
4. Accuracy & data sources
We aggregate data from OpenStreetMap (ODbL), USGS GNIS (public domain), Wikidata (CC0), Wikipedia (CC BY-SA), and the National Park Service. We try to verify the highest-impact facts (height, fees, dog policy) where we can. We mark inferred or unverified fields explicitly with an “inferred” badge or with empty placeholders.
Don't treat anything on this site as a substitute for the official land manager's page (NPS, US Forest Service, state parks, etc.). Trail conditions, fees, road closures, and pet policies change. We link to the official source on every waterfall page — check it before going.
5. Safety disclaimer
Waterfalls are dangerous. People die at them every year — slipping on wet rock, getting pulled under by hydraulics in the plunge pool, falling from cliff edges. See our full safety disclaimer for details. Short version: you're an adult, make your own decisions, and we're not responsible for your choices.
6. User contributions
If you email us a tip, correction, or photo, you grant us the right to publish it on the site with attribution (first name + state, or anonymous if requested). We may edit for length and clarity. You confirm you own the rights to anything you send us — don't send us someone else's photos. We don't pay for submissions.
7. Third-party links
We link to many external sites — NPS, USGS gauges, Wikipedia, state park pages. We're not responsible for the content of those sites. We don't earn commissions on those links.
8. Intellectual property
The Fallspots name, logo, layout, and original text are © 2026 Fallspots. The underlying data is from the public sources listed above and carries their respective licenses (ODbL, CC0, CC BY-SA, public domain).
Believe we're using your copyrighted material without permission? See our DMCA notice procedure.
9. Liability
The site is provided “as is”, without any warranty of accuracy, completeness, or fitness for any purpose. To the maximum extent permitted by law, we disclaim all liability for any harm, injury, financial loss, or other damages arising from your use of the site or your reliance on its content.
Some jurisdictions don't allow exclusion of certain implied warranties, so parts of this may not apply to you.
10. Changes to these terms
We may update these terms. The “Last updated” date at the top tracks when. Continued use after a change means you accept the new terms. If you don't, stop using the site.
11. Governing law
Any dispute will be governed by the laws of the United States and the state where Fallspots is operated, without regard to conflict-of-laws principles.
